Scratch Built SE5a

I scratch built this SE5a some years ago now.


It is Laser 70 powered and features "scale" cable and pulley aileron control (no ugly plastic control horns!) and a sequential bomb drop operated via the "retract" servo.

Throughout the construction I took photos and uploaded to another site, the intension being to hopefully provide some inspiration for other modellers to add that little extra scale detail and share the techniques I use. Unfortunately they have now started to charge for full access i.e. to see photos apart from small "thumb nails", which I am not happy about.

I have all my posts and associated photos stored on my computer and would like to start a new thread on a "free to view" site. Would this be acceptable here?

Can an SE5a ever be an "Own Design"? I did a complete redesign of the internal structure but did start from a plan so Build Blogs and Kit Reviews it will be. I really do feel strongly that these forums are by modellers for modellers and as such should be as our great British Health Service "free at the point of need", I appreciate there are costs involved in running any web site and I have no problem with adverts or the choice to pay for advert free.

 

Rant over let's get on with the interesting stuff, hopefully see you there.

Firstly under British Law  CDPA 1988, copyright belongs to the author of the images.....unless of course you are either employed to take them as a member of staff, or you sign legal documents to transfer copyright to the person that you give them to.   I am not a lawyer, but most contract law would suggest that you were fully aware of the transfer, and in agreement with its action. If they are charging people to enjoy your works, and this was not an open part of the agreement between you , then I suggest that the monies earned should be yours for the commercial use of your copyright works.  Say I photograph a Hotel and then find  the images I put on my website used to advertise and encourage clients to spend at that venue, then I am well within my rights to demand their removal, and damages for the abuse of my rights and my loss of revenue for a commercial use licence..... which of course would be granted on a time period basis for a renewable fee.  

 

So I guess I am suggesting you issue a DMCA takedown notice to the site, and a share of the commercial use that they have made.  Now we come to the copyright of your design , it might be argued you revoked that with the open offering its intricacies to the public in plans and words, ho9wever I would suggest that this was only for non profit usage, and the moment someone commercialises that use they infringe on you rights and design.  Did you patent it ? Do the Royal Aircraft Company own it as you did call it an SE5A.....   all far too much for the barrack room boy, but I know a man that will fleece you to find out 🙂 

 

PS.  The model is a beauty, and you should be very proud... I am in total envy.

Hello Ken

 

Nice to hear I haven't broken any laws, bit late now however, I've started the "new" thread.

 

My unhappiness is not because I think I deserve some of their profit, I think I'd be hard pressed to claim anyone would pay membership just to read my thread anyway!

 

Hope you enjoy the rest of the build thread.
